Does arbitration meet the expectations of business enterprises ?

Over the past few years, various institutions have been taking steps to increase the business community’s interest in arbitration. It is only fair to inquire whether arbitration is indeed worth popularising, and why only a small percentage of disputes centring on commercial matters go to arbitration. Based on my own experience as an arbitrator, I am confident that arbitration is in fact a great dispute resolution tool with potential applications in many realms of life. Whether we like it or not, disputes are something natural – they are bound to arise every now and again, and there is nothing that we can do about it. We can, however, take constructive steps towards their resolution. Resolution of disputes before an amicable tribunal is a much-needed alternative for business people vis a vis the general court system and, as such, merits encouragement (…)
