“Reimbursement of Drugs in Poland”, a report by GESSEL

1 January 2012 witnessed the coming into force of the legislative Act regarding reimbursement of drugs, foods for special medical purposes, and medical products (Journal of Laws of 2011, No 122, item 696), a statute which comprehensively regulates the reimbursement scheme for medicines and other medicinal comestibles and products operated as part of the universal healthcare system in Poland.

These new rules amounted to nothing less than a revolution concerning the means of awarding reimbursement as well as, more broadly, operation of the national reimbursement scheme. The report written by Dorota Bryndal and Adam Kraszewski – respectively, partner and managing associate – of GESSEL’s pharmaceutical law practice discusses the main premises of the system and the procedure for securing inclusion of a drug in the reimbursement scheme and, with the hindsight afforded by more than two years’ practical experience with the new statute, posits some points as to how the reimbursement act might be improved.
