“Lease Agreement for Commercial Space”, edited by Maciej Boryczko, the partner in charge of GESSEL’s real estate practice, is now available for pre-order with Wolters Kluwer.
The book is structured around an archetypal contract for lease of commercial space; after presenting this basic template, the authors proceed to discussing variants of clauses and alternative solutions which can be used to adapt the contract to the given set of circumstances, e.g. provisions concerning:
✅ Liquidated damages
✅ Periodic rent adjustments
✅ Defects of the premises
✅ Termination.
The various issues are explained from the perspective of the lessor as well as of the lessee. In another helpful element, the book presents a basic overview of the applicable tax duties (e.g. with respect to rent and to current fees).
The publication should make for interesting reading for lawyers advising business enterprises as well as for entrepreneurs and for members of management.
