New scientific publication by Dr. Bartłomiej Woźniak

The monograph is devoted to the theoretical aspects of trust and the protection of trust assets. As part of it, an analysis of Roman law, English law, Polish law, and European private law harmonization projects was carried out.

“I tried to show to what extent the experience of Roman law and the English regulation of the trust allows to conclude that the principle of material surrogacy, i.e. replacing one thing within a given property, enables the effective protection of trust assets and plays an important role among the legal protection measures available to the beneficiary of the trust. The main purpose of the work was to indicate, using the comparative and historical-legal methods, what features a given legal relationship should have to be able to define it as a trust,” says the author of the scientific publication, Dr. Bartłomiej Woźniak, managing associate at GESSEL.
