Privacy and Cookies Policy

I. INTRODUCTION

This Privacy and Cookies Policy (hereinafter referred to as “the Policy”) has been drawn up to ensure the privacy and safety of visitors to https://gessel.pl/ (“the Website”). The Policy presents a clear overview of the rules governing operation of the Website and subscriptions to our newsletter, handling of personal data, and gathering and processing the data of Website users.

The Website is operated by Gessel, Koziorowski Kancelaria Radców Prawnych i Adwokatów sp.p. (formerly Gessel, Koziorowski sp.k.) with its registered seat in Warsaw at ul. Sienna 39, 00-121 Warszawa, entered in the business enterprises register of the National Court Register maintained by the District Court for the capital city of Warsaw in Warsaw, Department XII – Commercial of the National Court Register under no. KRS 892064, tax ID no. NIP 5252070586.

II. PERSONAL DATA PROTECTION

Users’ personal data may be processed in accordance with this Policy as part of the Website’s operation. Personal data protection proceeds in compliance with the legislative Act of 10 May 2018 regarding personal data protection (Dz.U.2018.1000), Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“GDPR”), and such further legal instruments as may complement or replace the above.

KRS 892064, tax ID no. NIP 5252070586 (“GESSEL”).

GESSEL may disclose the personal data to its cooperating entities, in particular within the scope of marketing and IT services, and also to other entities entitled to access the personal data on authority of applicable laws.

III. SCOPE AND PURPOSE OF PERSONAL DATA PROCESSING

In the course of a visit to the Website, data concerning the user will be collected automatically, including in particular data concerning the user’s activities on the Website and the user’s IP address. Collection of this data may proceed with the use of cookies (please see par. VII of this Policy). In addition, the user may, on a voluntary basis, input her/his given name and surname, organisation name, and e-mail in order to subscribe to our newsletter.

Users’ data is processed for the purpose of: a) legitimate legal interests pursued by GESSEL, in particular ensuring safety, development, and optimum operation of the Website, improving service quality, safeguarding rights and prosecuting claims, and marketing and information activities – art. 6.1.f GDPR;

b) compliance with legal obligations incumbent on GESSEL – art. 6.1.c GDPR.

IV. YOUR RIGHTS

Users are entitled to, at any time, request access to their personal data, to correct their personal data, to demand deletion of their personal data or to impose restrictions on its use, to demand transfer of their personal data, and to lodge a complaint with the oversight authority – the Polish Personal Data Protection Office.

Within the scope in which data processing refers to pursuit of legitimate legal interests of GESSEL, users also have the right to, at any time, object to such processing. In the event of such an objection, GESSEL will not be able to process personal data unless it can prove existence of a valid and legally justified basis for processing thereof which overrides the interests, rights, and freedoms of the person to whom the data refers, or unless it can cite grounds for the definition, prosecution, or defence of/against claims. As regards data processed for direct marketing purposes, such an objection shall have the effect of blocking such processing in future unless GESSEL can cite special circumstances and unless it can prove existence of prerequisites entitling it to continue such processing.

V. DURATION OF PERSONAL DATA PROCESSING

Personal data shall be processed for as long as the user visits the Website and/or for the period of time necessary for the purposes for which the data has been collected. In addition, personal data shall be stored until any claims have been settled, or for as long as such potential claims have not expired under the statute of limitations.

VI. NEWSLETTER

GESSEL offers a newsletter to users who have signed up to receive it.

All users of the Website are welcome to voluntarily subscribe for the GESSEL newsletter. Users wishing to receive the newsletter are asked to provide the following data:

a) given name and surname;

b) company / organisation name;

c) e-mail.

With respect to newsletter subscriptions, users’ data is processed for the purpose of legitimate interests pursued by GESSEL in the form of marketing and information activities – art. 6.1.f GDPR.

If you wish to subscribe to the newsletter, you must consent to GESSEL sending you business information via electronic communications technologies in accordance with the legislative Act of 18 July 2002 regarding provision of services via electronic means (Dz.U.2019.123). If you refuse such consent, we will be unable to send you the newsletter. Consent, once granted, may be revoked at any time, in which event we will discontinue newsletter mailings to you.

The GESSEL newsletter is sent at different times and with varied frequency, as decided by GESSEL.

In order to fully benefit from our newsletter, users need a computer or another multimedia device with an internet connection as well as an active e-mail account.

In the newsletter, GESSEL endeavours to present content which is accurate and dependable. The foregoing notwithstanding, GESSEL makes the reservation that any information presented in the newsletter should not be regarded, or depended upon, as legal advice or as an official interpretation of applicable laws. GESSEL accepts no liability for any harm which may arise from, or in connection with, materials made available in the GESSEL newsletter.

Users who have signed up our newsletter may report to GESSEL any problems connected with their subscription and receipt of the newsletter (please see  X below).

The Website uses cookies.
