Art 177 § 1 of the Polish Labour Code, for instance, provides that an employer may not terminate an employee’s employment during her pregnancy or her maternity leave unless there arise grounds for termination of her engagement through her fault and the union organisation representing such employee has agreed. Yet this employment protection accorded to expecting mothers does not encompass termination with the employee’s consent, especially by way of mutual agreement of the parties – in such an instance, freedom of contract of the respective parties takes precedence over the protections instituted by the Labour Code (...)
