One of the legislative measures included in the Shield 1.0 package comprised amendment of art. 406 (5) of the Commercial Companies and Partnerships Code, the idea being to facilitate the holding of general meetings via electronic communications technologies.

One of the aspects regulated by this statutory provision is that of broadcast of general meetings. To wit, art. 406 (5) § 4 of the Commercial Companies and Partnerships Code provides that a public company shall ensure real-time broadcast of general meeting proceedings. Given the doubts surrounding practical application of this provision, we are setting out below a position which, we hope, may be of assistance in its construction.
