Poland faces arbitration and damages liability vis a vis Discovery for its “lex TVN”, and the Kowalskis will foot the bill from their taxes

The Law and Justice parliamentary caucus has presented a draft law which would obligate investors from outside the European Union to divest their stakes in Polish media companies. In the event, a law worded in this way would apply only to the TVN cannel and its American owner, Discovery. Piotr Schramm, partner in the GESSEL law firm, points out to Business Insider Polska that enactment of such a law will open Poland (and, it might be added, the Polish taxpayer) to international arbitration and, most likely, to penalties for breach of the bilateral investment treaty signed with the United States in the 1990s (…)
