Prof. Marek Michalski‘s commentary to the Regional Administrative Court judgment in case VI SA/Wa 707/20 handed down on 28 January 2020 was published in the December issue of Monitor Prawniczy (no. 23/2021). 

As Prof. Michalski explains, this decision may be taken as a case in point in discussing the somewhat haphazard regulation of capital concentrations within the Polish legal system. The issue at hand concerned the Pharmaceutical Law and the scope for involvement by entities supervising the pharmaceutical and medicinal products markets in cooperation and coordination between business entities erroneously construed as establishment of discrete capital entities.
