Financial litigation
Our finance and litigation team supports banks and financial institutions in litigation of all kinds. We assist in handling cases before the courts, including the Polish Supreme Court and the Court of Justice of the European Union, but also at the pre-litigation stage, in settlement processes, including negotiation and mediation, and during enforcement of benefits.
Combining experience in managing a large volume of litigation with a wide range of types of services provided and a very high level of expertise, we are able to provide clients with not only expert, but also expedient handling of mass cases as well as support in specific and precedent-setting cases at the highest level.
We are engaged in litigation challenging PLN loans with variable interest rates based on the WIBOR benchmark index. Not only do we closely follow related events, including the ongoing public debate on proposed changes to the index, and speak out in this discussion, but we also take an active part in pertinent litigation.
We also represent payment service providers in disputes over unauthorized payment transactions (phishing), as well as obligated institutions in proceedings concerning their liability for damages in connection with their anti-money laundering and anti-terrorist financing (AML) obligations.
A special place in our practice is devoted to disputes over loan agreements linked to foreign currencies (CHF, USD). In several such cases, we have managed to obtain settlements breaking hitherto well-established lines of jurisprudence. We are currently conducting over 1,000 parallel proceedings concerning borrowers’ claims based on allegations concerning the validity of CHF-denominated loan agreements as well as the restitution claims of banks.
