1. Introductory comments

As the saying goes, the best contracts are the ones which spend eternity gathering dust in a binder way up on the highest shelf. In such a case, performance had proceeded smoothly, the respective parties delivered on time, payment was duly remitted and everything went off without a glitch – in short, nobody had any need to revisit the exact terms of the covenant.
