Martyna specializes in litigation and comprehensive legal advice in civil law cases, especially business law, and criminal law (white-collar crimes).

She participates in the resolution of disputes at all stages of proceedings. Her practice encompasses a broad spectrum of litigation, including corporate disputes, in particular proceedings to annul or declare invalid the resolutions of shareholders’ meetings and proceedings to exclude a shareholder from the company, as well as disputes concerning unfair competition practices, or disputes involving M&A transactions.

As part of her practice, Martyna represents clients in complex construction law disputes, including those involving the construction of transmission networks.

Martyna represents clients in criminal cases, acting both as defense counsel, attorney for victims and as attorney for auxiliary prosecutors.

She has been with GESSEL  since 2018.

 

Experience

Civil

  • Represented IT companies in disputes with a shareholder over the revocation or annulment of resolutions of the shareholders’ meeting
  • Represented one of the largest IT companies, engaged in the development and provision of IT solutions for integration, visualization and advanced data analysis, in a dispute concerning the exclusion of a shareholder from the company and in a dispute concerning the dissolution of the company
  • Represented IT companies in disputes involving violations of non-compete obligations by former managers/board members
  • Represented a consortium in a dispute with a contracting authority arising out of the performance of a public facility construction contract
  • Represented an investor – a developer – in disputes over the takeover for compensation of a water supply network, sanitary sewer system and stormwater drainage system built by the investor
  • Represented a tissue and cell bank in a dispute over unfair competition acts with a cross-border dimension

Criminal

  • Represented defendants in cases involving criminal and fiscal offenses
  • Represented a director, in charge of the association’s property and business affairs, in a case involving the infliction of economic damage

  • Graduate (with honours) of the Faculty of Law and Administration at the University of Warsaw
