GESSEL AS THE DRIVING FORCE BEHIND AN INTERNATIONAL PROJECT: THE FDI GUIDE

For some years now, GESSEL has been a member of Lawyers Associated Worldwide (LAW) – an affiliation of leading lawyers from around the world.

As we see it, one of the chief advantages of membership in bodies such as this lies in the opportunity to exchange knowhow and compare notes. In this spirit, we decided to draw up a practical guide to the foreign investment vetting regimes in force in various European jurisdictions, approaching the relevant issues not only from the perspective of European Union Member States, but also other European countries.

The coronavirus pandemic has brought an uptick in liquidity problems among business enterprises as well as reduced valuations. This gave rise to political fears that the newly weakened companies may become take-over targets for “non-preferred” actors.

The legislatures of various countries, in Europe as well as further afield, duly moved to introduce new regulations intended to enable the state to screen potential investors and the sources of their funds. The blanket term for these controls is FDI regulations; while their general import is similar, the details of their implementation and enforcement vary from country to country.

The Guide draws on the invaluable input from our esteemed colleagues from various LAW member firms, coordinated by Krzysztof Jasiński, managing associate at GESSEL.
