We advised ANWIM S.A.

On 15 February 2024, the President of the Office of Competition and Consumer Protection (UOKIK) approved the acquisition by our long-standing client ANWIM S.A. – part of the Elbah II company (owner of the petrol stations).
The subject of the transaction is the purchase by Anwim of three petrol stations owned by Elbah II, in Chorzów, Radzionków and Tarnowskie Góry. In the course of the proceedings, the President of the Office for Competition and Consumer Protection examined the state of competition on the local markets within a radius of 2.5 km and 5 km from the acquired stations.
The scope of work included, among other things, a comprehensive description of the relevant markets on which entrepreneurs operate, together with an estimation of their market shares, which was quite a challenge because the UOKiK President defines the operation of fuel stations as local markets.
GESSEL was represented in the case by Bernadeta Kasztelan-Świetlik and Karolina Krzal-Kwiatkowska.
