GESSEL successfully supports Dariusz Tuzimek in safeguarding his legally protected personal interests

GESSEL advised Dariusz Tuzimek in his suit brought against Krzysztof Stanowski and the publisher of his book, “The State of Football. Secrets of the Pitch, the Locker Room, and the Corner Office”, over allegations concerning Mr Tuzimek’s professional activities propagated in the book and on the weszlo.com internet portal. 

We have won a decision in which the court rules that publication of the allegations in question has led to unlawful violation of our Client’s legally protected interests and, accordingly, issues an injunction prohibiting their continued publication on weszlo.com or in any further print runs or editions of the book. The court also ordered publication of a statement of apology on the publisher’s website and on weszlo.com and awarded recompense for the violations. This verdict is final, with no further possibility of ordinary appeal.

The case may well be of relevance to the multi-faceted debate as to the limits of legitimate criticism, depending as they do on any number of factors – the circumstances in which criticism is voiced, established custom, or the underlying objectives of the criticism.
